Our firm has filed the first class action lawsuit to reclaim the amount of mortgage and arrangement fees, as reported by several media sources.
The lawsuit, which has been filed in the Courts of First Instance of Seville, claims €120,000 from La Caixa and will be added to three other class actions that our firm plans to file against Banco Santander, BBVA and CajaSur for an amount of more than €450,000.
In 2015, the Supreme Court declared null and void the clauses that impose the consumer to pay the costs of constitution and formalisation of the mortgage. It is estimated that more than 6 million mortgage contracts include this clause, which would mean the collection of more than 450 million euros in just one year.
According to our estimates, claiming the amount of mortgage expenses means that each consumer can recover an average of €3,000 plus the arrangement fees, which represent between 0.5% and 4% of the total loan. This is a not insignificant figure that leads thousands of people to consider what they should do to claim the amount of mortgage expenses and to initiate actions to recover the money paid in excess.
Recently, Bufete Salmerón reached a pioneering agreement with Cajasur whereby the financial institution refunded the mortgage arrangement fees to one of its clients without the need to go to court.
