Our firm has achieved a new success by which Unicaja will return to 26 families from La Carolina (Jaén) more than 667.000€ for the purchase of unfinished houses, plus 6% interest plus costs.
The purchasers, who had advanced an average of €26,000 per family, had bought their homes from Construcción y Financiación Soberino S.A.
In the words of the Director of Bufete Salmerón, “this ruling follows the line of recent judgments obtained by our firm, making the bank liable for the amounts advanced by homebuyers in their accounts when there is no bank guarantee”.
However, the lawyer continues, “it also has a novelty and that is to consider that the bank is responsible for the amounts advanced even without specifying the concept of the income due to the fact that the financial entity cannot demonstrate another source”.
This ruling, which due to its social relevance has been reported in various media, joins many others that our firm has already obtained, such as the one that recently condemned Abanca to return more than €62,000 to a ghost home buyer in Malaga and Banco Sabadell for a unfinished home in Alicante.
