The Court of First Instance No. 1 of La Carolina (Jaen) sentences the financial institution Unicaja to pay a client of Bufete Salmerón 30,000 €.
This Court sentenced the financial institution to pay the money paid by a buyer of a property promoted by the developer Construcción y Financiación Soberino, as well as to pay the costs of the process.
According to Fernando Salmerón, Director of Bufete Salmerón, who obtained this ruling, it confirms that the bank must always be liable, regardless of whether or not there is an individual guarantee given by the developer to the buyer of the property. In this case, there was no guarantee constituted to guarantee the amounts paid on account.
