Seville, 04 December 2018-. Bufete Salmerón reached an agreement with GENERALI SEGUROS SA whereby the insurance company returned 89,477.72 euros based on the guarantee policy in respect of the amounts paid in 2006 by a purchaser of an off-plan home in the “Cortijo del Mar” Residential Complex Development, in Estepona.
In the lawsuit filed, Bufete Salmerón demanded the fulfilment of the guarantee policy from GENERALI SEGUROS SA, due to the fact that the developer refused to return the amounts paid for the purchase of a property.
With the agreed out-of-court settlement, i.e., 100% of what was requested in the claim plus interest, GENERALI SEGUROS SA assumes its responsibility for payment.
In 2015 the Supreme Court declared the liability of financial institutions in this type of case. It is estimated that there are tens of thousands of off-plan purchase contracts in which the Bank could be held liable, or the insurance company in the event that there was a guarantee policy taken out by the Developer.
